1. Acceptance of these terms

These Terms & Conditions (“Terms”) are an agreement between you and Wove(“we,” “us,” or “our”) and govern your use of the website at wovesleep.com (the “Site”), including the waitlist and journal signup forms. By using the Site or submitting a signup form, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

2. Who may use the Site

You must be at least 18 years old, or the age of majority where you live, to use the Site or join the waitlist. The Site is not directed to children under 16.

3. Early access, the waitlist, and the journal

Wove Node is in development. Joining the waitlist or subscribing to the journal lets us keep you informed — nothing more. In particular:

• It does not create any order, pre-order, or contract to buy anything, and it is not an offer by us to sell anything.
• We make no promise about if or when Wove Node will be available, its final features, or its price. Any pricing or product details shown on the Site are indicative and may change.
• Forward-looking statements about the product describe our current plans, not guarantees. Please do not make decisions in reliance on them.

4. Electronic communications

When you sign up, you consent to receive the electronic communications you asked for (waitlist updates or the journal) at the email address you provide. You can withdraw that consent at any time using the unsubscribe link in any email or by contacting [email protected]. You agree that agreements and notices we provide electronically satisfy any legal requirement that they be in writing.

5. Acceptable use

You agree not to:

• Use the Site for any unlawful purpose or in breach of these Terms.
• Submit false information, or someone else’s information without their permission.
• Scrape, harvest, or use automated means to collect data from the Site, or attempt to submit signups in bulk.
• Interfere with, disrupt, probe, or attempt to gain unauthorized access to the Site, its systems, or its data.
• Reverse engineer, copy, or create derivative works from the Site except as allowed by law.

6. Intellectual property

The Site and its contents — including text, design, graphics, images, the Wove name and logo, and the Wove Node product design — are owned by Wove or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to view the Site for your own personal, non-commercial use. No other rights are granted.

7. Third-party links

The Site, including the journal, may link to third-party websites we do not control. We provide those links for convenience and do not endorse or take responsibility for the content, products, or practices of any third-party site. Your use of them is at your own risk and subject to their terms.

8. Disclaimer of warranties

The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that any information on it is accurate or complete. This includes any forward-looking information about Wove Node.

9. Limitation of liability

To the fullest extent permitted by law, Wove and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the Site. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars (US$100).

Some jurisdictions do not allow certain warranty exclusions or liability limits, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify and hold Wove harmless from any claims, damages, and expenses (including reasonable legal fees) arising out of your misuse of the Site or your breach of these Terms.

11. Changes to the Site and these Terms

We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms; when we do, we will update the effective date above. Your continued use of the Site after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in California will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Site, and you consent to the jurisdiction of those courts.

13. General

These Terms and our Privacy Policy are the entire agreement between you and Wove regarding the Site. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent.
